Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you," "your") and ScrapeKit.ai ("we," "us," "our"). By creating an account or using the service you agree to be bound by them. If you do not agree, do not use the service.

1. The service

ScrapeKit.ai provides software tools to find and verify publicly available business contact information, including Google Maps scraping, email verification, spintax generation, and spam checking. The service runs on a pre-paid credit model.

2. Your account

• You must provide a valid email address and verify it before accessing paid features.
• You are responsible for keeping your password secure and for all activity on your account.
• One account per person. Multiple accounts to abuse signup bonuses, referral credits, or trial features may be merged or terminated.
• You must be at least 16 years old to use the service.

3. Acceptable use

You agree not to:

• Use the service to send unsolicited bulk email that violates CAN-SPAM, GDPR, UK PECR, or any applicable anti-spam law in the recipient's jurisdiction.
• Target individuals (as opposed to businesses) in jurisdictions where scraping personal contact data requires consent.
• Resell access to the service without a written agreement with us.
• Reverse-engineer, scrape, or automate against the ScrapeKit service itself.
• Use the service to harass, defraud, or defame any person or organisation.
• Use the service in any way that would breach Google's, any upstream provider's, or applicable law's terms.

4. Credits, payments, and refunds

• Credits are pre-paid, non-transferable, and have no cash value.
• Prices and credit amounts are shown at checkout. Card payments are processed by Stripe; crypto payments by NOWPayments.
• Credits do not expire under normal operation but may be forfeited if your account is terminated for breach of these Terms.
• Referral and signup-bonus credits are promotional and may be clawed back if the triggering signup or purchase is later found to be fraudulent.
• Refunds: because credits are consumed on demand, purchases are generally non-refundable. If the service materially fails to perform as described, contact support@scrapekit.ai within 14 days of purchase and we will consider a prorated refund of unused credits at our discretion. EU/UK consumers who qualify for statutory withdrawal rights may exercise them unless service delivery has already begun with their explicit consent.

5. Referral program

The referral program is a promotional feature. We may modify the bonus amounts, change the rules, or end the program at any time. Self-referrals and fraudulent referrals will be rejected or reversed. Referral credits earned through abuse may be removed and the offending account terminated.

6. Availability, limits, and changes

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance, third-party outages (Google, Stripe, NOWPayments, DNS providers), or abuse mitigation may cause temporary downtime. We may change features, pricing, or credit rates; material changes will be announced on the site.

7. Intellectual property

The ScrapeKit software, branding, and site content are owned by us. You retain ownership of any lists you scrape or input. By using the service, you grant us a limited licence to process that data solely to deliver the service to you.

8. Termination

You may close your account at any time by emailing support@scrapekit.ai. We may suspend or terminate an account that breaches these Terms, attempts to defraud the service, or poses a legal risk. Upon termination, any unused credits are forfeited except where law requires otherwise.

9. Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT SCRAPED DATA IS ACCURATE, CURRENT, OR LAWFUL FOR YOUR INTENDED USE.

10. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the service will not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenue, or data.

11. Indemnity

You agree to indemnify and hold us harmless from any claim, demand, or damages (including reasonable legal fees) arising from your use of the service or your breach of these Terms, including claims from recipients of emails you send using data obtained through ScrapeKit.

12. Governing law

These Terms are governed by the laws of Ireland. Any dispute will be subject to the exclusive jurisdiction of the courts of Ireland, unless mandatory consumer protection law in your country of residence provides otherwise.

13. Changes to these Terms

We may revise these Terms. We will post the new version with an updated date at the top. Continued use of the service after changes constitutes acceptance.
